The Board of Directors was advised by the HOA attorney for the need to reaffirm the existing Hidden Oak Estates Homeowners Association as a legal entity. From what we understand, this action was necessary because of unclear direction from the Florida district courts regarding homeowners associations that have been in existence for more than 30 years. On Friday, August 11th, your Board of Directors followed our attorney’s advice and voted unanimously to revitalize our original covenants. We are now waiting for further clarification from our attorney to ensure all requirements have been satisfied. It is the board’s intention not to proceed with voting on the new covenants until this issue is fully resolved.
We hope to outline the voting procedure at the upcoming September meeting of the board.
Our goal is to make it as easy as possible for members to vote while still maintaining accuracy and integrity.
To address concerns raised at last week’s special Board meeting, once the regular September Board meeting is concluded, members are invited to stay and ask questions about the proposed new covenants.
